The Supreme Court on Thursday allowed the Chhattisgarh government to seek cancellation of bail for retired IAS officer Anil Tuteja if he misuses it. The bench said, “The state can approach the high court for cancellation if tny misuse of bail.” The trial will remain unaffected by observations.

The Supreme Court on Thursday allowed the Chhattisgarh government to approach the high court to seek cancellation of bail granted to retired senior IAS officer Anil Tuteja in corruption cases if he misuses the relief, news agency Press Trust of India reported.

The court, however, refused to consider the state government's plea challenging the high court's decision to grant bail to Tuteja in fresh corruption cases. It clarified that the high court's observations while granting bail would not influence the trial.

A bench comprising Chief Justice Surya Kant and Justices Joymalya Bagchi and V Mohana said the state could approach the high court if there were any instances of misuse of bail.

“The state can approach the high court for cancellation if there is any misuse of bail We agree with you. There is a strong suspicion that they are involved in corruption. But that suspicion has to be converted into foolproof evidence,” the Chief Justice said.

“We have heard the learned standing counsel for the state of Chhattisgarh at considerable length. The findings made by the high court are for the limited purpose of granting bail. The trial court shall not be influenced by those observations,” the bench said, according to PTI.

The orders under challenge, granting bail to Tuteja, were passed in December 2025 and January 2026. The Supreme Court said any instance of misuse of bail could be brought to the high court's notice for its cancellation.

Tuteja, who held important positions during the Bhupesh Baghel government, is under investigation in several corruption cases. These include the alleged liquor scam, suspected irregularities in the District Mineral Fund and the coal levy case.

The Chhattisgarh Economic Offence Wing and Anti-Corruption Bureau recently filed their 10th supplementary charge sheet in the alleged liquor scam. It named 20 people, including former state Congress treasurer Ramgopal Agrawal, and 22 firms as accused.

On May 18, the Supreme Court granted bail to Tuteja in a corruption case involving alleged irregularities in the District Mineral Fund. He had been in jail since January 24, 2024, in connection with various corruption cases before securing bail.

The Supreme Court has thus left it open to the Chhattisgarh government to seek cancellation of Tuteja's bail before the high court if the relief is misused, while directing that observations made during the bail proceedings should not affect the trial.
