Protests against Gyanesh Kumar | Key points

-The protests against CEC Gyanesh Kumar began on October 2, however, the detentions by security forces have triggered calls for extension of the agitation, with the Cockroach Janta Party (CJP) announcing a mega demonstration on October 10. Abhijeet Dipke's CJP led protest against CEC Gyanesh Kumar from Mumbai's Shivaji Park on October 2.

-On Sunday, security officials and protesters clashed for at least three hours in central Delhi on Sunday, the third consecutive day of protests against chief election commissioner (CEC) Gyanesh Kumar over alleged irregularities in the ongoing Special Intensive Revision (SIR) of electoral rolls. More than 120 people were briefly detained as police reiterated that no permission had been granted for the demonstrations. While protesters alleged they had been manhandled, police said they used minimum force.

-The protest was also escalated by the accusation of three women journalists against police officers of sexually harassing them during the protest against the Election Commission (EC) at Jantar Mantar on Saturday. Their complaints were forwarded to the crime branch for a detailed probe, the police said on Sunday. In a post on X, the Delhi Police said: “On October 3, during the protest in New Delhi area, while being in law and order situation, allegations of sexual harassment were made by three female journalists against police officers. The New Delhi district has received their complaints and the same are transferred to crime branch for fair and impartial enquiry.”

-On Monday, protests continued while an agitation outside Parliament Street Police Station in Delhi also continued parallelly over the allegations against police officers of sexually harassing journalists. Meanwhile, Congress's student wing NSUI also staged a symbolic protest near Jantar Mantar, demanding the resignation of CEC Gyanesh Kumar.

The Supreme Court bench, comprising Chief Justice of India Surya Kant and justices Joymalya Bagchi and V Mohana, issued notice to the Election Commission of India, the Union government, the CEC and two ECs, on a petition filed by social activist Rakesh Kumar Singh, while making it clear that any decision found to have been taken contrary to the statutory requirement governing the functioning of the poll panel could subsequently be injuncted.

Singh pressed for an interim order suspending Kumar immediately, saying the credibility of the Election Commission was at stake. “We are facing a very grave situation. We have been known in the world for conducting free and fair elections but here the CEC’s working…” he said.

The bench, however, cautioned against acting on allegations before receiving the ECI’s response. “Let us not have an authentic information about the averments made by you,” it said.

SC news LIVE: Saying that the poll body leadership is expected to take unanimous decisions, the Supreme Court on Monday refused to pass an interim order suspending chief election commission Gyanesh Kumar.

The top court was hearing pleas challenging alleged “unilateral” decisions taken by Gyanesh Kumar, not keeping his two election commissioners in loop. The petitions were triggered by a news investigation report that claimed election commissioners Sukhbir Singh Sandhu and Vivek Joshi objected on record at least 14 times over the past 10 months to decisions and orders on the SIR that they said were issued without their knowledge or recommendation.

“They are expected to take unanimous decisions...if there is no unanimity, it has to be by majority. Today, you are going only on a news report,” CJI Surya Kant said on Monday, hearing the pleas.

“News report may be fully or partially correct. We will like their response,” LiveLaw quoted CJI Kant as saying.

Protest news LIVE: Three women journalists have accused police officers of sexual harassment during the protest against the Election Commission (EC) at Jantar Mantar on Saturday and their complaints have been forwarded to the crime branch for a detailed probe, the police said on Sunday.

In a post on X, the Delhi Police said: “On October 3, during the protest in New Delhi area, while being in law and order situation, allegations of sexual harassment were made by three female journalists against police officers. The New Delhi district has received their complaints and the same are transferred to crime branch for fair and impartial enquiry.”

The three women journalists said officers, deployed on the spot, inappropriately touched them as they were covering the protests. The number of officer nor their identities have been shared so far.

On Saturday evening, several independent journalists and social media influencers staged a protest outside Parliament Street police station, seeking registration of First Information Reports (FIRs) against the officers. On Sunday also, people reached there and demanded FIRs. Read full report here
